Filing Deadline

Record the construction lien no later than 180 days after final completion of the original contract. If the owner records a Notice of Completion on the State Construction Registry (SCR), the deadline shortens to 90 days after the Notice of Completion is filed (but never later than 180 days after final completion).

Clock starts: Final completion of the original (prime) contract for the project — not the claimant's last day of work. A recorded Notice of Completion accelerates the clock to 90 days.

Where to Record

Office of the County Recorder in the Utah county where the project property is physically located (e.g., Salt Lake County Recorder for projects in SLC). Recording fees are set by the county — currently $40 for the first page and $2 per additional page at most Utah recorders, but the generator should not hard-code the fee.

Service Requirement

Within 30 days after recording the lien with the county recorder, the claimant must deliver or mail a copy of the recorded notice of construction lien to the reputed owner of the property (or the record owner if reputed owner is unknown). Certified mail to the owner's last known address is the safe practice and creates a paper trail. Failure to timely serve the owner can invalidate the lien.

Utah Warning

You almost certainly already lost lien rights if you did not file a Preliminary Notice on the State Construction Registry (scr.utah.gov) within 20 days of your first day of work. Utah is one of the strictest states on this — late preliminary notices only protect work done within 5 days before the filing date and afterward, not the labor or materials you already supplied. The lien itself is step three, not step one.
