Filing Deadline

60 days from last date of furnishing labor/materials for Class 2 residential structures (single/double-family dwellings); 90 days for all other projects (commercial, industrial, utilities, multi-family). Deadline is to RECORD the sworn statement and notice of intention to hold a lien.

Clock starts: Last date the claimant actually performed labor or delivered materials to the project (not punch-list or warranty work).

Where to Record

County Recorder's office in the Indiana county where the real property is physically located. Must be filed in DUPLICATE (two original copies). In Marion County (Indianapolis), this is the Marion County Recorder. Recording fees vary by county (typically $25 for the first page plus per-page fees).

Service Requirement

Indiana is unusual in that the COUNTY RECORDER (not the claimant) is statutorily required to mail one of the duplicate copies to the property owner at the tax-record address by first-class mail within 3 business days after recording (IC 32-28-3-3(d)). The claimant is NOT required to personally serve the owner after recording. However, the claimant must retain proof of mailing/recording for any future foreclosure action. For the pre-lien notice on owner-occupied residential, the claimant must both record AND deliver/mail it to the owner.

Indiana Warning

The owner's name and address on the lien MUST match the most recent county property tax records exactly — Indiana courts have voided liens for using the deed address, mailing address, or trade name when the tax records showed a different name/address. Always pull the current tax record before filing. Second biggest gotcha: forgetting the owner-occupied residential pre-lien notice (sub/supplier on a house) — this is a hard void, no cure.
